Yes, and this is the single most expensive thing Nevada owners get wrong. The exemption is over $600,000, which is excellent, and it does nothing for you until a declaration is recorded with the county recorder. Filing it after a creditor has a judgment generally will not help against that creditor.
Does the charging order rule keep them out of my company?
Against a creditor holding only a personal judgment against you, NRS 86.401 limits them to a charging order on distributions. In a typical MCA that is cold comfort, because the funder holds a claim against the entity as well as the guarantee and has a UCC-1 on the company’s receivables. It helps at the margins, not at the center.
